There are many medical experts in China, who did hail the ban, but there are also those, who criticized the regulation as being arbitrary. One of the hospital’s directors consider that such kind of a prohibition had to be issued long time ago. There were several surrogacy operations performed in that hospital, and the director of it considers that all gestational surrogacy agreements involve a lot of money. She also underlines that if this kind of practice will not be taken under control, there exist a risk of potentially chaotic situations development, and there are people, who may begin to earn their living by carrying the children of other intended parents.
Another reason of the regulation, prohibiting gestational surrogacy being issued is the potential risk for a surrogate mother. Despite the fact, that about 95 % of women carry a baby during all pregnancy term safety, still there are medical problems existing, and they do include some risk. And there is no person, who would be responsible for the surrogate mother’s health or, even for her life, in case of some danger.
There was an analogy of someone, who suffers from terminal cancer provided as to the fact that the prohibition deprives many infertile couples of their right to become parents. The cancer does deprive the patient of his life, although there is no person, who wished it to happen. The same happens to those people, who are able to conceive a baby, because they are infertile, of an older age, or have damaged or missing uterus. Of course they are deprived of the happiness to become mothers, and it is the reason of regret for the whole family; but if there are laws and regulations, issued against gestational surrogacy arrangements, these people are to respect them.
There are people, who vote against the issued prohibition, as they consider that no one has right to deprive infertile or ill people of the right to have their own children, and, especially, if there are means, which are able to provide remedy to the situation. As for the money, these people consider that if the gestational surrogacy is voluntary, there is no problem arises; there are people, who want to have children, and there are people, who want to have money.
There are propositions to install some restrictions, but not the complete gestational surrogacy prohibition. Their mind is that the complete prohibition will neither help any people, nor it will be able to assist reproductive science research. But still, the issue, which does prohibit gestational surrogacy, has been working for three years by this time, and the director of the Science Education Department under the Ministry of Health points out that there are only few people, who became really affected by the issued prohibition. He says, that there are about 10 – 15 % of Chinese couples, who suffer from any kind of reproduction dysfunction, and only 10 % of these people really need the assistance of the human – reproduction technology.
