Agreement is made this ___day of ___, ___ by and between ___ (here and after referred to as a surrogate mother), ___ (here and after referred to as surrogate’s husband), ___ (here and after referred to as an intended father) and ___ (here and after referred to as an intended mother).
The term surrogate mother stands for a woman, who is going to undergo an embryo transfer procedure utilizing an embryo / embryos, created from the sperm of the genetic father and the egg / eggs of an egg donor, who does not take part in the agreement, and carry mentioned embryo / embryos to term for delivery to the genetic father and intended mother. The term a genetic father stands for the sperm donor, whose sperm is used in the process of the eggs of a designated egg donor fertilization, which is conducted with the aim of the embryo creation, which will then be transferred to the surrogate mother. It should also be noted, that the egg donor is not a party of this surrogacy agreement. The term intended mother stands for the wife of the genetic father. The term child / children stands for every child / all children, born to the surrogate mother pursuant to the terms of this contract.
The contract is made with the reference to the following facts: 1. The genetic father is a married individual, who is over the age of eighteen (18) years, and who desires to enter into the following agreement. 2. The genetic father wants to have a child / children, who is / are biologically connected with him. 3. The intended mother is not able to conceive and / or carry her pregnancy to term, or she has been advised by a physician that pregnancy would be dangerous to her health / life and / or health / life of any child / children she may conceive. 4. The surrogate mother is a married individual, who is over the age of eighteen (18) years, and who desires to enter into the following agreement. Now therefore, taking into consideration the mutual promises, which are contained herein and with the intention to be legally bound hereby, the Participants agree as follows:
