Following and to the extent requested before the arrival of the child / children, all the participants of this surrogacy agreement will have to sign documents and do any acts, which will be necessary to d in order to fulfill the intend of the participants, and to make the genetic father and intended mother the actual and legal parents of the child / children.
The surrogate mother and her husband / boyfriend, if there is any, are to represent that they will freely, readily and within a reasonable period of time after the execution of this surrogacy agreement and after the arrival of the child / children effectuate the intent of this surrogacy agreement and make all necessary legal actions with the aim to terminate any parental rights to the child / children pursuant to this surrogacy agreement, and to assist in effecting the aim and intend of this surrogacy agreement and ensure the custodial placement of the child / children with the genetic father and intended mother. The surrogate mother and her husband / boyfriend, if there is any, are to enter into any consent agreement with respect to the genetic father’s and intended mother’s custody and parentage of the child / children.
The surrogate mother and her husband / boyfriend, if there is any, are to represent that they believe that the child / children, conceived pursuant to this surrogacy agreement, should be raised by the genetic father and intended mother without any interference from the side of the surrogate mother and her husband / boyfriend, if there is any, and without any retention or assertion by them of any parental rights. The surrogate mother and her husband / boyfriend, if there is any, are to agree that as soon as it becomes possible from the medical point of view, they will terminate their respective putative parental rights. Subsequent to the arrival of the child / children, all participants of this surrogacy agreement are to agree to participate voluntary in any necessary blood testing to conclusively legally determine the paternity of the child / children, as may be ordered by a court, or requested by either participant of this surrogacy agreement.
Considering the provisions of this surrogacy agreement, the genetic father and intended mother are to agree to indemnify, defend as well as hold harmless the surrogate mother and her husband / boyfriend, if there is any, from and against any and all causes of action, suits, claims, damages, losses, costs as well as expenses, including without any kind of limitation attorney fees, court costs and litigation expenses, suffered or incurred by either the surrogate mother or her husband / boyfriend, if there is any, in the result of or in connection with the participation, involvement or activities of the designated egg donor, which is not the participant of this surrogacy agreement.
