F. The Surrogate Mother is to represent that she has had a consultation with either a physician or a surgeon of her own choice, and that she is aware of all possible medical risks, including death, which may result from the conduct contemplated by this Surrogacy Agreement. In addition, the Surrogate Mother does realize that the risks involve the medical examinations, pregnancy, the delivery process as well as any possible postpartum complication. All these risks have been explained to the Surrogate Mother by a physician after the thorough medical examination of the Surrogate Mother. The Surrogate Mother and her Husband, if there is any, are to agree to assume all possible risks, and hold harmless against any of these risks, the Couple of the Intended Parents, the attorneys, who represent the Participants of this Surrogacy Agreement, including, however not limited to the professionals as well as all other contemplated and / or involved in any aspect of performance under the terms of this Surrogacy Agreement. However, this does not mean at all that the medical professionals are released from liability for any damage or injury due to the acts of willful misconduct, negligence and / or medical malpractice. The Surrogate Mother is to represent that she has already signed all necessary medical release forms. The Couple of the Intended Parents is to represent that they have already signed all medical release forms.
G. The Couple of the Intended Parents shall take custody of, as well as assume complete legal and parental responsibility for any Child / Children, regardless of if the Child / Children suffers / suffer from any congenital or other abnormality or defect, right after the Child’s / Children’s arrival, and the Surrogacy Agreement’s Participants do acknowledge that they are aware of and have been advised of the above mentioned risks of congenital abnormalities or defects by their physician.
H. The Surrogate Mother is to agree that she will avoid having sexual intercourse with anyone except her husband, who is sterile, beginning from the first day of her menstrual cycle before the Artificial Insemination procedure is conducted and up until the date, when the pregnancy is confirmed by either the Surrogate Mother’s Obstetrician, Gynecologist, Midwife, or by Family Physician.
I. The Surrogate Mother is to agree that she will comply with all medical instructions, which will be given to her by her physician and either by her independent obstetrician or midwife. 1. The Surrogate Mother is also to agree that she will follow her prenatal examination schedule, as will be prescribed either by her independent obstetrician or by her midwife. In addition, the Surrogate Mother agrees to adhere to and follow all requirements regarding the application of medicines and vitamins, which are prescribed either by her obstetrician or midwife. In addition, the Surrogate Mother is to agree to submit any medical tests and / or procedures, which will be necessary or advisable to conduct. Any medical testing, which is not covered by the Surrogate Mother’s insurance, is to be paid by the Couple of the Intended Parents. 2. The Surrogate Mother is to agree that she will not take part in any dangerous kind of sport as well as in any hazardous activity. She is also to promise that she will not allow herself to be exposed to radiation, any toxic chemical or communicable diseases. 3. The Surrogate Mother is to agree that she will not smoke, drink alcohol, and / or use any illegal drugs, as well as prescription or non – prescription drugs, which may be dangerous for the health of the Child / Children.
J. The Surrogate Mother is to agree that she will not undergo the abortion procedure, once conceived, except if this action will be necessary in the opinion of either her independent obstetrician, midwife or her treating physician, in order to avoid any potential risk of physical harm to the Surrogate Mother.
K. In case if this Surrogacy Agreement Participants ever choose to resume the procedure after an abortion is conducted, this Surrogacy Agreement shall remain in full force and effect.
L. The procedure of Selective Termination of Multiple Fetuses. In case if in the result of the Artificial Insemination procedure there will be three or more fetuses, it is possible that the Participants of this Surrogacy Agreement may agree to conduct a fetal reduction procedure with the aim to reduce the number of fetuses. The Surrogate Mother is to agree that she will not have the reduction procedure conducted against the will of the Couple of the Intended Parents, except if this procedure will be necessary in the opinion of either her independent obstetrician or midwife and / or her treating physician, with the aim of avoiding physical harm to the Surrogate Mother.
