Surrogacy contracts are allowed to gay, lesbian, bisexual and transgender individuals and couples in Vermont, but it is not completely certain.

Virginia

Virginia law allows uncompensated surrogacy agreements, but it is prohibited to same-sex couples to take part in these contracts.

Washington

Washington permits free of charge surrogacy agreements when the intended parents cover only medical and legal expenses of the surrogate mother.
