Arkansas Arkansas law allows surrogacy contracts, but it is unclear how courts may apply the law to surrogacy situations that concern gay, lesbian and bisexual couples.
California California has no law about surrogacy, however its courts one after another have acknowledged both traditional and gestational surrogacy agreements.
Colorado There were no cases in law of Colorado either reported or published dealing with the problem of surrogacy.
Connecticut While the law of Connecticut doesn’t state anything regarding surrogacy agreements, its courts have addressed cases involving these kinds of agreements and acknowledged their terms.
Delaware While Delaware law does not deal with any kind of surrogacy arrangements, and one court has recognized that such agreements are against the state’s public policy.
District of Columbia The law of District of Columbia bans surrogacy agreements.
